A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.

The situation originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to face alien smuggling allegations, he was held in federal custody.

In her order, the court noted that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
